Background
Board policy on temporary operating permits (TOPs) is located in its policy manual.
Section 38 of the Passenger Transportation Act authorizes the Board to approve an application by a licensee to temporarily increase their fleet size if the Board considers that there is a “temporary and urgent” need for the vehicles. In addition to Regular TOPs, the Board has implemented a streamlined Peak Season TOP (PS TOP) process for limousines and other PDVs to accommodate peak periods. This application is for a PS TOP.
The Board recognizes that limousine and other PDV operators may experience spikes in demand for service at various times throughout the year, such as during the festive, grad, ski, or summer season. To meet cyclical demands and serve their client base, operators may need to increase their fleet temporarily.
The PS TOP policy applies only to those licensees who must charge hourly rates pursuant to the Board’s Rates Rule - Limousine Rates Rule.
PS TOPs may be cumulative. In any calendar year, which starts on January 1, a licensee may apply for a maximum of one of the following PS TOP timeframes:
- Three – 30-day PS TOPs
- One – 60-day PS TOP and one – 30-day PS TOP
- One – 92-day PS TOP
The maximum number of vehicles permitted for a PS TOP timeframe is:

TOP requests outside of the PS TOP parameters must be submitted through the regular TOP process where evidence of “temporary and urgent” need is required.
Reasons
The applicant has a PT Licence (#75339) with a Special Authorization: Passenger Directed Vehicles. The applicant is approved to operate three vehicles of which one may only be a large vehicle and two may only be perimeter seating buses (PSBs). This application is for one vehicle for 92 days. This is within the PS TOP policy.
I approve the PS TOP request. This 92-day permit starts any time on or after June 20, 2025, and expires on September 19, 2025, at 11:59 pm.
I establish the terms and conditions of the permit that are attached to this decision in Appendices 1 and 2. These form an integral part of the decision.
